Canada-United States-Mexico Agreement (CUSMA) Work Permits

If you are a Mexican or US citizen, you may be eligible for temporary entry into Canada without a Labour Market Impact Assessment (LMIA).

Ratified in 2020, the Canada-United States-Mexico Agreement (CUSMA) is a free-trade agreement signed between Canada, Mexico and the United States which allows reciprocal labour mobility.

As an employer:

  • you are exempt from obtaining a Labour Marketing Impact Assessment (LMIA) in an occupation that is classified under the Canada-United States-Mexico Agreement (CUSMA).

There are four different categories to which you may apply:

  • Professionals
  • Intra-Company Transferees
  • Traders and Investors
  • Business Visitors

Professionals

As a professional, you may apply for a work permit before entering Canada or at a Canadian port of entry.

You may qualify if:

  • you have received an offer of employment in a skilled occupation from a Canadian employer
  • the employment is an approved occupation listed in CUSMA 
  • you meet Canada’s basic entry requirements

Intra-Company Transfers (ICT)

If you are sent from a US or Mexico parent company to work for a subsidiary, branch or sister company in Canada, you may be eligible to apply for a work permit.

You may qualify if:

  • you have worked for the same company for at least one year within three years in the US or Mexico
  • you have worked as a manager, executive, or in a position that uses specialized knowledge
  • you meet Canada’s basic entry requirements

Traders and Investors

If you intend to trade and invest in a Canadian company that is an American or Mexican enterprise, you may be eligible to apply.

You may qualify if:

  • you will be involved in planning at the supervisor or executive level
  • you will work to provide important skills and services to the enterprise, or
  • you invest to develop and direct the enterprise in Canada

Under this category, it is advised to apply for your work permit before coming to Canada.

Business Visitors

If you plan to come to Canada to do international business without engaging in the Canadian labour market, you do not require a work permit.

As a business visitor, you can come to Canada temporarily in order to help grow your business by participating, exploring or investing in Canada’s economy.

You may qualify if:

  • your main source of income and profits remains outside of Canada
  • you meet Canada’s basic entry requirements
